Widelens — Terms of Service

These terms apply to anyone booking Widelens for event coverage, and to anyone accessing or purchasing images through the Widelens online gallery. By booking a session, registering for a gallery, or purchasing an image, you agree to these terms.
Separate terms apply to the actual use of any digital image you purchase or download, see the Digital Image Usage Terms, which you'll be asked to accept at the point of purchase.
1. Bookings & Fees
Bookings are confirmed on receipt of a deposit, which is nonrefundable except where required by the Consumer Guarantees Act 1993 (see clause 7).
Full payment is due prior to the session or event unless otherwise agreed in writing. Prices are as listed at time of booking or purchase and may change for future bookings without notice.
2. Copyright
Widelens (Mel Parkin) is the photographer and retains copyright in all images captured, in accordance with the Copyright Act 1994.
Where images are captured at a public or ticketed sporting event (rather than commissioned privately by an individual client), copyright remains with Widelens regardless of who appears in the image or who purchases a copy.
Purchasing an image grants a licence to use it under the terms set out in the separate Digital Image Usage Terms, it does not transfer copyright.
3. Gallery Access & Registration
Access to event galleries is by registration (e.g. QR code + email address) and may be restricted to competitors, family, and eventaffiliated parties.
You're responsible for keeping your own access details secure and for any activity under your registration.
Images can be marked private on request or by the subject/parentguardian; private images are hidden from general gallery view but Widelens retains the right to use them per the Digital Image Usage Terms unless a separate agreement states otherwise.
Where a subject is a minor, a parent or guardian is responsible for registration, privacy settings, and any purchase made on the minor's behalf. (NB: Best efforts are made to not photograph any subjects who have provided notice of opting out of photography for events).
4. Client & Attendee Responsibility
Anyone attending a session or event is responsible for their own conduct and that of anyone in their care.
Widelens may decline to continue coverage where conduct is abusive, unsafe, or unreasonably disruptive.
5. Cancellation & Rescheduling
Requests to cancel or reschedule must be given as much notice as reasonably possible.
Deposits are nonrefundable, except where Widelens is unable to deliver the agreed service (see clause 7).
Widelens will make reasonable efforts to reschedule where an event is cancelled or postponed for reasons outside anyone's control (e.g. weather, venue closure).
6. Delivery & Editing
Edited images will be delivered within the timeframe advised at booking or on the gallery page.
Additional or custom editing beyond standard delivery may incur extra cost, to be agreed before work begins.
7. Your Rights Under NZ Law
Nothing in these terms limits your rights under the Consumer Guarantees Act 1993 or Fair Trading Act 1986. Where those Acts apply and can't lawfully be excluded, they aren't excluded.
Where something goes wrong with the service itself (not simply a change of mind), you may be entitled to a remedy under the CGA regardless of the "nonrefundable" wording above.
Outside of that, Widelens's liability for loss connected to a booking (e.g. equipment failure, illness, an event being cancelled) is limited to a refund or reschedule of the fees paid, whichever is more appropriate in the circumstances.
8. Privacy
Personal information (e.g. name, email) collected at registration is used only to manage gallery access and image delivery, and won't be sold or shared with third parties outside of running the gallery service.
Handling of this information follows the Privacy Act 2020.
9. Disputes
Any disagreement will first be raised directly with Widelens for resolution. If that doesn't resolve it, either party may pursue mediation before any formal legal process.
10. Acceptance
Booking a session, registering for a gallery, or purchasing an image means you accept these terms and the separate Digital Image Usage Terms.
